General Terms and Conditions of Sale

1. Purpose
These General Terms and Conditions of Sale govern the contractual relationship between PRO HEADSPA (SIRET: 80761650300015), located at 13 rue de Joinville, 75019 Paris, and any person placing an order through the Pro Headspa website. Placing an order implies full and unconditional acceptance of these Terms and Conditions.

2. Order processing
Orders placed on our website are confirmed by email after validation. If a product is unavailable, the customer will be informed as soon as possible and may choose either a refund or a replacement with an equivalent product. NJ Coiffure reserves the right to cancel an order in the event of a dispute or non-payment.

3. Prices and payment
Product prices are stated in euros, including all taxes, excluding delivery charges. Payment can be made by bank card, bank transfer or in several interest-free instalments. The order will be validated upon receipt of full payment.

4. Warranty terms
Our products benefit from the statutory guarantee of conformity (Articles L217-4 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code). The warranty period is 24 months. The warranty covers manufacturing defects or failures resulting from normal use. It does not apply to damage caused by misuse or insufficient maintenance.

  • Activation and validity of the commercial warranty are strictly conditional upon full payment of the agreed price.
    Where payment is made in instalments or split payments, the commercial warranty takes effect only upon receipt of full payment for the order, unless otherwise agreed in writing.

  • In the event of non-payment, even partial, the seller reserves the right to refuse any claim under the commercial warranty until the situation has been fully remedied.

  • The commercial warranty applies without prejudice to the statutory guarantees provided for in Articles L.217-3 to L.217-20 of the French Consumer Code and Articles 1641 to 1649 of the French Civil Code, which remain fully applicable regardless of the payment situation.

  • Retention of title
    In accordance with Article 2367 of the French Civil Code, the seller retains full ownership of the delivered products until the price has been effectively paid in full.
    In the event of non-payment, even partial, the seller reserves the right to repossess the products at the customer's expense and risk, without prior authorisation from a judge.

5. Limitation of liability
Pro Headspa cannot be held liable for delivery delays caused by unforeseen events (force majeure) or carrier disruptions. If a product is temporarily unavailable, we will make every effort to offer an equivalent alternative or a refund.

6. Zheng Hege training organisation
Zheng Hege is a professional training organisation located at 13 rue de Joinville, 75019 Paris. It offers and delivers inter-company and intra-company training in France, independently or in partnership.

7. Definitions

  • Customer: any natural or legal person who registers for or orders a training course from Zheng Hege.
  • Trainee: the natural person who attends a training course.
  • Terms and Conditions: these General Terms and Conditions of Sale.
  • OPCO: approved skills operators responsible for collecting and managing companies' training contributions.

8. Purpose and scope
These Terms and Conditions determine the conditions applicable to training services provided by Zheng Hege on behalf of a customer. Any order for training implies full and unconditional acceptance of these Terms and Conditions, which prevail over any other customer document.

9. Quotation and certificate
For each training course, Zheng Hege provides the customer with a quotation, which must be returned completed, dated, signed and stamped with the wording “Approved and agreed”. A specific agreement may be entered into with the OPCO or the customer. At the customer's request, a certificate of attendance or completion may be provided.

10. Prices and payment terms
Training prices are stated in euros excluding tax. SAS NJ Coiffure is exempt from VAT. Payment is due after the service, upon receipt of the invoice, with a deposit required to confirm registration. Payment may be made by bank transfer or bank card. Payment in instalments may be accepted subject to conditions agreed before the start of the training course.

11. OPCO funding
If the customer benefits from OPCO funding, they must apply before the service begins and provide confirmation of funding upon registration. If the OPCO has not paid the funding by the first day of training, the full cost will be invoiced to the customer.

12. Rescheduling and cancellation
A training course may be cancelled provided written notice is given at least 10 days before the session begins. All cancellations must be sent by email to proheadspa@gmail.com. If cancellation occurs after this deadline, the customer remains liable for the full training fee. Rescheduling may be requested in writing at least 30 days before the training course. In the event of force majeure, Zheng Hege cannot be held liable and customers will be informed by email.

13. Training programmes
The trainer may modify course content according to current developments, group dynamics or participants' level. Programmes shown on course information sheets are provided for guidance only.

14. Intellectual property and copyright
Training materials in all forms (paper, digital, electronic, etc.) are protected by intellectual property and copyright law. Any reproduction, transmission or use for training purposes without Zheng Hege's consent is prohibited.

15. Data protection
Personal information provided by the customer is used to process registrations and manage customer relations. In accordance with the French Data Protection Act of 6 January 1978, customers have the right to access, rectify and object to the processing of their personal data. Zheng Hege implements measures to ensure data security and confidentiality and undertakes not to disclose it unless legally required.

16. Governing law and jurisdiction
These Terms and Conditions are governed by French law. In the event of a dispute, an amicable solution will be sought as a priority. Failing this, the matter will be brought before the courts of Paris.
